Iowa let its regulator act against illegal sweepstakes without defining the term

What the law does

Section 4 of Senate File 2289 rewrote Iowa Code section 99F.4, subsection 13, which sets out a power of the Racing and Gaming Commission¹. Before the change, that subsection let the commission take any reasonable or appropriate action to enforce chapter 99F and its rules, naming no tools and no sweepstakes³. The amended text says those actions include issuing cease and desist orders and obtaining injunctive relief against a person offering games of chance, gambling, sports wagering, or illegal sweepstakes in Iowa without a commission license or other specific authorization in law¹. Sections 2 and 3 of the same Act wrote similar language into section 99D.7 for pari-mutuel and advance deposit wagering and into section 99E.3 for internet fantasy sports contests¹. The subsection reaches the person offering the game and names no payment processor, platform or promoter¹. It sets no fine or jail term of its own; its remedies are a commission order and a court injunction¹.

What has happened since

Both chambers passed the bill with no dissenting vote; the Governor signed it on May 15, 2026, and it became Acts chapter 1092². The licensing department's memorandum proposed wording for this subsection that named gambling games, sports wagering and advance deposit sports wagering, not sweepstakes⁴. The enacted text adds games of chance and illegal sweepstakes¹. The amended subsection took effect on July 1, 2026, and our event history for Iowa holds that date as its only entry, “SF 2289: IRGC authority over illegal sweepstakes takes effect”. The commission's newsroom, read on September 28, 2026, lists only revenue releases since then, none about an order against a sweepstakes operator⁵. What is still open

Neither the Act nor chapter 99F defines illegal sweepstakes, and outside the amended subsection the chapter does not use the word sweepstakes¹³. The department's memorandum tied its proposal to a rise in complaints about online casinos and described virtual slot machines and table games as “not legal in Iowa”⁴. That leaves a question the record has not answered: does the phrase cover every dual-currency site where Sweeps Coins won on slot-style games can be redeemed for cash, or only a sweepstakes that some other provision of Iowa law already makes unlawful?
