What the law does
The classification record cites the wagering section, 97-33-1, and the gambling device section, 97-33-71. Section 97-33-8 is the sweepstakes section, and it opens by saying it clarifies that running an internet sweepstakes cafe is illegal gambling activity1. It makes it unlawful for any person or entity to possess, own, control, display, operate or have a financial interest in an electronic video monitor offered for play of a simulated gambling program for direct or indirect consideration, where the player may become eligible for a cash or cash-equivalent prize1. The monitor is any unit, computer, terminal or device that can display moving or still images, and consideration includes money paid for a related product, a sweepstakes entry among them1. Promotions for a product its maker or seller offers for sale are exempt1. In the text SB 2104 reproduced, a violation is a misdemeanor with a fine of up to $1,000 or imprisonment "for not less than one (1) year," or both1.
What has happened since
In 2026, SB 2104 tried to carry that section from the cafe to the web2. As introduced, it inserted "or platform" after the monitor, named "online sweepstakes casinos" alongside the cafes, and moved the offense from a misdemeanor to a felony1. The version the Senate passed added a safe harbor for internet, cable and app store providers, which a provider loses if it keeps promoting a platform after learning that the platform is operating illegally in the state3. The Senate vote on February 4, 2026 was 52 to 04. The House sent the bill to its Gaming Committee on February 6, and it died there on March 3, 20262. What is still open
The first question is whether section 97-33-8, as written, reaches a remote site at all1. Its offense turns on possessing, controlling, operating or having a financial interest in the screen itself, while a player reaches a sweepstakes site on a phone or computer of their own. The Senate's move to add "or platform" does not answer whether the current words already cover a platform, and the bill never took effect2. The second question is whether a Gold Coin package is the kind of product the promotion exemption has in mind, given that SB 2104 would have excluded digital tokens and coins tied to a sweepstakes game from it1. Neither point has been tested in a Mississippi court ruling, attorney general opinion or Gaming Commission action that our record holds.

What the law says
Current law: betting or promoting betting on games of chance is a misdemeanor with a fine up to $500 and up to 90 days imprisonment if unpaid (§ 97-33-1); prohibited gambling devices are subject to seizure and destruction with no property right in them (§ 97-33-7(2)). Pending SB 2104 would make operating an online platform facilitating illegal wagering a felony: up to $100,000 fine and/or 10 years, with asset forfeiture and venue in Hinds County at the AG's discretion.
