West Virginia's cited statute reaches the bettor, and our record holds no dated action

What the law does

Section 61-10-5 of the West Virginia Code is a single sentence¹. It covers any person who, at any place, public or private, bets or wages money or other thing of value on any game of chance, and any person who knowingly furnishes money or value to another person to bet on such a game¹. The text names only those roles, the bettor and the one who stakes the bettor. It is silent on a business that runs the game, online play, virtual coins and free entry. The offense is a misdemeanor with a fine of not less than $5 nor more than $300, security for good behavior for one year if the court requires it, and ten to thirty days in county jail on default of the fine, the costs and any required bond¹.
