Arizona's status rests on its general gambling chapter and a regulator program

What the law does

The classification leans on the criminal code's general gambling chapter. Section 13-3303 says a person commits promotion of gambling by knowingly, for a benefit, conducting, managing or financing gambling, or by furnishing advice or assistance toward that conduct². Amusement, regulated and social gambling fall outside that offense². Section 13-3301 defines gambling as risking or giving something of value for the chance at a benefit from a game or contest of chance or skill, or from a future contingent event¹. The carve outs have limits written into them. Social gambling in section 13-3301 covers only play not conducted as a business¹. Amusement gambling requires, among other conditions, that prizes not be offered as a lure to separate players from their money, and in its replay and skill game branches it limits the benefit to an unrecorded replay right with no exchange value or to merchandise under fixed dollar caps¹. Section 13-3303 classifies promotion of gambling as a class 5 felony².

What has happened since

Our record holds no effective date for Arizona, because the classification rests on the general gambling chapter rather than a sweepstakes statute with a start date. The status reads enforcement activity because the classification record cites a Department of Gaming cease-and-desist program.
