Idaho separates casino simulations from no-purchase promotions
Idaho Constitution article III, section 20 says gambling is contrary to public policy and strictly prohibited except for an authorized state lottery, pari-mutuel betting, and qualifying charitable bingo and raffles. It also bars those permitted activities from using casino gambling or electronic or electromechanical imitations or simulations of casino gambling. That simulation language makes Idaho's constitutional text unusually specific for this page family.
The same constitutional section excludes merchant promotional contests conducted incidentally to a bona fide nongaming business when participants are not charged consideration, along with games that award only additional play. Idaho Code section 18-3801 uses a separate value-and-chance definition and repeats those exclusions. The state-specific issue is not simply whether a site calls itself a sweepstakes.
