Idaho's constitution bans gambling and leaves the penalty to statute

What the law does

Article III, section 20 of Idaho's constitution declares gambling against public policy and prohibits it, with three exceptions that each need enabling legislation: a state lottery, pari-mutuel betting, and bingo and raffles run by qualified charities¹. Subsection (2) says none of those allowed activities may employ casino gambling, slot machines included, or any electronic or electromechanical imitation or simulation of it¹. Subsection (4) removes two things from the ban: merchant promotional contests and drawings run incidentally to a bona fide nongaming business when participants are charged no consideration, and games that award only additional play¹. Idaho Code section 18-3801 defines gambling as risking money or anything else of value for gain that depends on chance, a gambling device or an event's outcome². It repeats both carve-outs and adds skill contests, valid contracts and acts expressly authorized by law². Neither text sets a penalty: subsection (3) tells the legislature to provide penalties by law, and section 18-3801 is a definition¹².

What has happened since

The history line on the official statute page records that section 18-3801 was added in the first extraordinary session of 1992, as chapter 2, section 3 of that session's laws². The constitution page prints no amendment history for section 20, so this note does not date the simulation clause¹. Our event history for Idaho holds no tracked legal event or operator exit, and the state row carries no effective date, so the banned status we record rests on the constitution and a definition added in 1992¹², not on a dated action against a sweepstakes site. We record 119 of the tracked operators as not accepting Idaho players, and those records come from operator terms, from a site configuration, and from our own bulk backfill, which cites no terms. None of them reflects a state order.

What is still open

The first open question is which offense a case would rest on. The constitution leaves penalties to the legislature and section 18-3801 only defines the term, so the offense section and its grade are outside the two texts we cite¹². The second is how the merchant contest exception reads against a dual-currency site. It applies only when prizes are awarded without consideration being charged to participants². Whether a Gold Coin purchase that comes with Sweeps Coins is that consideration has no answer in our record, which holds no attorney general opinion or court ruling for Idaho. A third is whether the simulation language in subsection (2), written about the lottery and the other allowed games, has any bearing on a private promotion¹.
