What the law says
General gambling promotion = class A misdemeanor (3rd-degree felony on prior conviction), 76-9-1405. 'Fringe gambling' regime expressly captures dual-currency sweeps and denies the promotional carve-out to casino-simulation / pretextual-transaction designs. Heavy private enforcement: 15+ Utah class actions (Nov 2025) using a 2x-loss recovery statute.
How we got here
- 2026-05-06 effective: Amends Utah Code 76-9-1401 to add proposition bets to the statutory definition of gambling and make conforming changes to the fringe gambling definitions, including the anti-circumvention language for devices that seek to avoid the part or Utah Const. art. VI § 27. source
- 2025-05-07 effective: Utah's fringe gambling part is renumbered and amended at Utah Code 76-9-1401 et seq. "Fringe gambling" covers any de facto form of gambling, lottery, fringe gaming device, or video gaming device offered by a business in exchange for anything of value — the definitions that reach sweepstakes-style dual-currency casino platforms, alongside Utah Const. art. VI § 27's blanket gambling ban. source
