Alabama's enacted lottery prohibition remains distinct from 2026 gaming proposals

Alabama Constitution Article IV, section 65 says the Legislature may not authorize lotteries or gift enterprises and must prohibit lottery or gift-enterprise tickets and schemes in the nature of a lottery. Code Title 13A, chapter 12 contains current gambling offenses and definitions. HB448 proposed a 2026 constitutional amendment for a state lottery and related gaming changes. The reviewed official record identifies it as introduced proposal text, not an enacted change.

The enacted constitutional text is broad, but the reviewed Alabama sources do not expressly classify every Gold Coin and Sweeps Coin product. A product-specific analysis still turns on consideration, chance, prize or gift-enterprise characteristics, the no-purchase route, and whether a redeemable currency is property or another thing of value. The Attorney General's 2016 cease-and-desist action against paid daily fantasy sports operators is historical agency action involving a different product. Pending HB41 (2025) would raise promoting-gambling and device offenses to Class C felonies (Class B on repeat).
