Alabama's gambling code counts free play and cash-exchangeable tokens as things of value
What the law does
With no tracked statute aimed at sweepstakes games, a reading of Alabama law starts from the gambling article in Title 13A, chapter 12 of the Code4. Section 13A-12-20 says a person gambles by staking or risking something of value on a contest of chance, on an understanding that he or someone else will receive something of value if a certain outcome occurs1. It counts as something of value any token, object or article exchangeable for money or property, and also a privilege of playing at a game or scheme without charge1. Section 13A-12-22 reaches anyone who knowingly advances or profits from unlawful gambling otherwise than as a player3. The definitions in section 13A-12-20 treat soliciting or inducing people to take part as advancing it1. Section 13A-12-21 reaches a person who knowingly advances or profits from unlawful gambling as a player2. Unlawful, in this article, means not specifically authorized by law1.
What has happened since
Our event history for Alabama holds no dated legal event, so the classification on this page rests on the current text of the gambling article, which HB41 of 2025 sets out as its base text4. The bill our state record cites is HB41 of the 2025 Regular Session, which was prefiled on September 11, 2024, read for the first time on February 4, 2025, and referred to the House committee on Economic Development and Tourism4. Its synopsis says it would raise the penalties for gambling crimes and would name electronic bingo, video lottery terminals and historical simulcast horse racing machines as illegal gambling devices4. Its definitions would also bring prepaid Internet minutes and other items of nominal value into the lottery ticket definition when buying them carries a chance to win a prize4. Simple gambling (playing) is a Class C misdemeanor (§ 13A-12-21); promoting gambling is a Class A misdemeanor (§ 13A-12-22); possession of a gambling device is a Class A misdemeanor (§ 13A-12-27), with forfeiture of devices, records, and stakes under § 13A-12-30. Pending HB41 (2025) would raise promoting-gambling and device offenses to Class C felonies (Class B on repeat).
