Kansas has an enacted consideration test and a failed 2026 exemption proposal

Kansas Statutes section 21-6403 defines a bet, lottery, consideration, and gambling device. A lottery involves consideration and an opportunity to win a prize by chance. Consideration includes a commercial or financial advantage to the promoter or disadvantage to the participant, while mere registration without purchase and certain no-fee participation methods are excluded. The gambling-device definition includes a slot or other device that may deliver or entitle a person to money or property by chance. Sections 21-6404 and 21-6406 address gambling, commercial gambling, and related penalties.

Senate Bill 516 proposed exemptions and new treatment for certain amusement machines and contests, including devices involving cash equivalents, gift cards, vouchers, or credits. The official bill page marks SB516 as died, so its proposed language is not current law. The enacted statutes do not use modern Gold Coin and Sweeps Coin labels. A particular product still raises questions about whether purchasing Gold Coins creates consideration, whether a free AMOE changes the participant's disadvantage, whether Sweeps Coins are money or property, and whether the online game is a gambling device.
