South Dakota's internet gambling chapter turns on a valuable thing and authorization

South Dakota's Internet Gambling chapter defines a bet or wager as directly or indirectly taking money or a valuable thing with an agreement that payment or delivery depends on a race, contest, game, or uncertain event. It defines gambling business broadly and prohibits internet betting and establishing an internet gambling site unless the conduct is for state lottery or Commission on Gaming licensees. A violation occurs when it originates or terminates in South Dakota, each bet can be separate, and section 22-25A-10 supplies felony penalties. The statute does not name sweepstakes or dual currency.

The official 2026 Gambling subject index lists measures about pari-mutuel licensing, bingo, lottery, pull-tabs, gaming revenue, and video lottery, but does not identify a sweepstakes-specific measure. Those entries are legislative context, not changes to the enacted chapter. The authorization exceptions cover the state lottery and licensed Deadwood gaming, not an online social-casino license.
