Virginia counts a purchase as a bet even when the same chance is free, if a device runs it
What the law does
Virginia's gambling article never defines a sweepstakes, so the clauses that matter for a Sweeps Coin site are the device and purchase clauses of section 18.2-3251. Subdivision 3 b counts as a gambling device any machine or contrivance, "or electronic or video versions thereof," that by elements of chance may determine a prize1. Subdivision 1 treats buying a product or Internet access for a chance to win through such a device as a bet, even if the same chance is offered without a purchase1. Subdivision 4 defines the operator as anyone who conducts, finances, manages, supervises, directs or owns all or part of an illegal gambling enterprise1. Section 18.2-328 makes that operator guilty of a felony, while section 18.2-326 treats a person who illegally gambles as guilty of a misdemeanor23.
What has happened since
Sweepstakes language reached the 2026 General Assembly session through SB579 and through the internet gaming bill HB161, and neither produced law46. SB579, prefiled by Senator Bryce Reeves on January 14, 2026, would have added operating, promoting or supporting an online sweepstakes game to the definition of illegal gambling, with a civil penalty of $10,000 to $100,000 per violation4. On February 11, 2026 the Senate Courts of Justice Committee continued it to 2027 by a vote of 14 to 14. A substitute offered that day would instead have had the Virginia Lottery Board convene a work group to study these games and report by December 1, 20265. HB161 passed the House 67 to 30 on February 17, 2026, then failed to pass from conference on March 146.
What is still open
Is a website or app that runs casino-style games for Sweeps Coins an electronic or video version of a gambling device under subdivision 3 b1? If it is, the purchase clause in subdivision 1 would reach a purchase made for a chance to win through that device, whether or not a free request route exists, so the device question comes before any question about the free route1. Our record holds no Virginia court ruling, attorney general opinion or agency action applying the device language to a remote site. SB579 would have written a separate definition of online sweepstakes games into the same section, and the record does not show whether legislators see that as filling a gap in current law or as restating it4.
