Wyoming's regulator calls sweepstakes sites unlicensed; its gambling law never names them
What the law does
Wyoming's criminal code, Title 6, never uses the word sweepstakes, so the question runs through its gambling article1. Section 6-7-101 counts as gambling risking property for gain on lot or chance, wholly or partly, in a game of cards, dice, balls or a gambling device, or on an event the bettor cannot control, and it defines gain as the direct realization of winnings1. The same section carves out bona fide business transactions valid under contract law, activities the Gaming Commission authorizes under Title 11, chapter 25, online sports wagering and fantasy contests1. A private game escapes only if, among other conditions, it is not advertised or open to the public1. Aiding or inducing another to gamble with intent to profit is professional gambling, the felony tier of section 6-7-102, while plain gambling is the misdemeanor tier1. Section 6-7-104 leaves a private business free to advertise an excluded activity run as a promotion clearly occasional and ancillary to its primary business1.
What has happened since
Our event history for Wyoming holds no tracked legal event, which means no enacted bill, no court ruling and no operator exit. The record beyond it is regulator guidance: on May 22, 2025, the Gaming Commission published a warning in which Executive Director Nicholas Larramendy said that "no online casino, iGaming, or sweepstakes site is licensed by the Wyoming Gaming Commission, and they are all operating illegally in Wyoming"2. The release adds that some unlicensed operations have formed Wyoming LLCs and show Wyoming addresses on their websites2. A working draft labeled 27LSO-0098 would add running an online casino or sweepstakes game, and knowingly supplying payment processing, geolocation, hosting or advertising for one, to the professional gambling definition, effective July 1, 20273. Its cover says draft only and not approved for introduction3. Our operator record marks 11 tracked brands as not taking Wyoming players.
What is still open
The central question is whether buying a Gold Coin package that carries Sweeps Coins is risking property for gain under section 6-7-101, given that gain means the direct realization of winnings and sweepstakes operators also offer a free way to enter1. A second is what the Commission's position rests on, because the 2025 release states a conclusion without tying it to any section of Title 6 or Title 112. A third is whether a sweepstakes that is a company's main product could ever match the description in section 6-7-104 of a promotion that is occasional and ancillary, the provision on promotions by a private business1. Whether the working draft reaches the 2027 session as a filed bill is not settled by anything in our record3.
