PRIMARY-SOURCE BRIEF

Wyoming's regulator has taken a stronger position than its current statute

Wyoming Statutes section 6-7-101 defines gambling as risking property for gain contingent in whole or part on chance, with exceptions for skill contests, bona fide business transactions, authorized acts, charitable gaming, the state lottery, licensed Commission activities, online sports wagering, and fantasy sports. Section 6-7-102 makes gambling a misdemeanor and professional gambling a felony. Neither section expressly names online sweepstakes. Consumer-protection provisions in sections 40-12-202 and 40-12-203 regulate written prize notices and prohibit asking for payment before required disclosures.

The Wyoming Gaming Commission's May 22, 2025 warning says no online casino, iGaming, or sweepstakes site is licensed by the Commission and takes the position that sites offering real-money payouts are operating illegally. This is regulator guidance and a specific warning, not a new statute or court judgment. A 2026 interim committee working draft titled Online casinos and sweepstakes prohibited proposes amendments, but it is marked draft only and not approved for introduction. It cannot be treated as enacted law. Free Gold Coin play, purchased currency, redeemable Sweeps Coins, and chance may affect whether property is risked for gain.

Enforcement search: The Commission's May 2025 warning is specific regulator guidance against unlicensed online casinos and sweepstakes sites, but it does not name operators or report a completed prosecution. No Wyoming court judgment naming a dual-currency operator was located.
Question still open: Whether free-entry and dual-currency mechanics still involve risking property for gain under section 6-7-101, and how the Commission applies its position to products without direct monetary wagering, remains unresolved.
